Tildai Tech has not appointed a Data Protection Officer (DPO) as we do not currently meet the thresholds requiring one under Article 37 GDPR or Section 24 of the Kenya Data Protection Act, 2019. Specifically, our core activities do not involve large-scale regular and systematic monitoring of individuals, nor large-scale processing of special categories of data.

Tildai Tech ("we," "our," or "us") operates ShiftManager, a platform that helps individuals manage work shifts and track earnings across multiple workplaces. This Privacy Policy explains how we collect, use, store, share, and protect your personal data when you use our platform, in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR"), the Kenya Data Protection Act No. 24 of 2019 ("DPA"), and applicable data protection laws.
This policy applies to all users of ShiftManager. Specific provisions for users in the European Economic Area (EEA) and Kenya are noted where applicable. If you are under 18 years of age, you may not use this service.
When you create an account and use ShiftManager, we collect the following:

Nature of data provision (Art. 13(2)(e) GDPR): The provision of your personal data is not a statutory (legal) requirement. It is a contractual requirement necessary to enter into and perform our service agreement with you. You are not legally obliged to provide your personal data, but if you do not provide the fields marked "Required" in the table above, we will be unable to create your account or deliver the ShiftManager service to you. Optional fields (such as phone number) enhance your experience but are not necessary to use the core service.

Sensitivity notice: Pay rates and earnings data is financially sensitive information. We treat this data with heightened care and offer optional field-level encryption at rest (see Section 7: Data Security).
If you subscribe to a paid plan, payments are processed by Stripe and/or M-Pesa (Safaricom). These providers collect your payment details (card number, mobile money account, billing information) directly. ShiftManager does not store your full payment card number or M-Pesa PIN. We receive only:

Your right to object: Where we rely on legitimate interest, you have the right to object to that processing. If you do, we will stop unless we can demonstrate compelling legitimate grounds that override your interests. See Section 8 for how to exercise this right.
Automated decision-making: We do not use your data for automated decision-making or profiling that produces legal or similarly significant effects on you (Article 22 GDPR). All shift calculations and earnings reports are mechanical computations based on data you enter — no algorithmic scoring, risk profiling, or automated employment decisions are made.
We do not sell, rent, or trade your personal data. We never have, and we will not do so without your explicit consent.
We share your data only in the limited circumstances described below. In each case, we share only the minimum data necessary for the stated purpose.

If Tildai Tech is involved in a merger, acquisition, or sale of assets, your personal data may be transferred to the successor entity. We will notify you via email and/or a prominent notice on our platform before your data is transferred and becomes subject to a different privacy policy. You will have the right to request deletion of your data before such transfer takes effect.
We will share your data with third parties not listed above only if you provide specific, informed, and freely given consent for that particular sharing. You can withdraw such consent at any time.
ShiftManager is operated by Tildai Tech, based in Kenya. If you are located in the European Economic Area (EEA), your personal data will be transferred to and processed in countries outside the EEA that may not provide the same level of data protection as your home country.

For transfers of your personal data to Kenya, where no adequacy decision exists, we rely on your explicit consent under Article 49(1)(a) GDPR.

What happens if you withdraw transfer consent:
During the grace period, we will continue to process your data on our Kenyan servers solely to allow you to access and export it. Once the grace period ends, processing ceases entirely.
Even in the absence of an adequacy decision, we apply the following protections to all data transferred to Kenya:
We are actively working to implement Standard Contractual Clauses (SCCs) approved by the European Commission (Commission Implementing Decision (EU) 2021/914) as an additional transfer mechanism alongside consent. Our target is to have SCCs executed with Truehost within 12 months of launch, at which point international transfers will be covered by both consent and SCCs. We will update this policy when SCCs are in place and notify users of the change.
In the interim, we consider explicit, informed consent under Art. 49(1)(a) to be appropriate given our current scale of processing, and we apply the supplementary safeguards described in Section 5.3 to mitigate the risks arising from the absence of an adequacy decision.
Where Stripe or Safaricom transfer your payment data internationally, they do so under their own legal mechanisms and privacy policies. We are not the controller for those transfers.
We keep your personal data only for as long as necessary to fulfil the purposes described in this policy, or as required by law.

We do not currently operate an automated backup system. If we implement one in the future, this policy will be updated to state the backup retention period and the process for ensuring deleted data is also removed from backups.

We take the security of your personal data seriously and implement appropriate technical and organisational measures in accordance with Article 32 of the GDPR and Section 41 of the Kenya DPA to protect against unauthorised access, alteration, disclosure, or destruction.

Right of access — You have the right to request a copy of all personal data we hold about you, in a commonly used electronic format (JSON or CSV).
Right to rectification — You have the right to request correction of inaccurate personal data, or completion of incomplete data. You can also update most information through your account settings.
Right to erasure ("right to be forgotten") — You have the right to request deletion of your personal data. Upon request, we will delete your account and associated data within 30 days, except where retention is required by law.
Right to restriction of processing — You have the right to request that we temporarily stop processing your data (while still storing it) in certain circumstances.
Right to data portability — You have the right to receive your personal data in a structured, commonly used, and machine-readable format (JSON or CSV), and to transmit it to another service.
Right to object — You have the right to object to processing based on legitimate interest. You have an absolute right to object to processing for direct marketing purposes at any time.
Right regarding automated decision-making — You have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. ShiftManager does not engage in such processing.

ShiftManager is a workplace shift management and income tracking platform designed exclusively for individuals aged 18 and older. The nature of the service — managing employment schedules, hourly pay rates, and earnings — makes it inherently intended for adults of legal working age.
Under both the GDPR (Article 8) and the Kenya Data Protection Act, 2019 (Section 2), we recognise our heightened obligations regarding the personal data of minors.
We do not knowingly collect, process, or store personal data from anyone under the age of 18.
During account registration, users are required to provide their date of birth. The system will automatically reject registrations where the calculated age is under 18. While this is not independent age verification technology (such as ID document checking), it provides a stronger safeguard than a simple checkbox. We will terminate accounts where we subsequently discover or have reasonable grounds to believe the user is under 18.
